Terms of service

1. The Agreement 

The agreement consists of these terms of sale, information provided in the ordering system, and any separately agreed conditions. In the event of conflict, separately agreed terms take precedence, unless they conflict with mandatory legislation. The agreement is supplemented by relevant legal provisions governing purchases between businesses and consumers.


2. The Parties 

The seller is Talga Cosmetics by Sara Jakobsen, organisation number 935372372, Vinkelstien 3, 9403 Harstad, +4748504747, support@talgacosmetics.no — referred to as the seller. The buyer is the consumer placing the order — referred to as the buyer.


3. Price 

The stated price for goods and services is the total price the buyer shall pay, including all taxes and additional costs in Norway. The buyer is not responsible for any costs the seller has not disclosed prior to purchase, unless the product is shipped outside of Norway. We are not responsible for any.


4. Formation of Agreement 


The agreement is binding on both parties once the buyer has submitted their order. It is not binding if a typing or input error occurred in the seller's offer or the buyer's order, and the other party knew or should have known of the error.


5. Payment

 The seller may request payment from the time the goods are dispatched. If paying by credit or debit card, the amount may be reserved at the time of order and charged on the day of dispatch. If paying by invoice, the invoice is issued at the time of dispatch with a minimum payment term of 14 days. Buyers under 18 may not pay by subsequent invoice.


6. Delivery

 Delivery is considered complete when the buyer or their representative has taken possession of the goods. If no delivery time is stated, the seller shall deliver without undue delay and no later than 30 days after the order. Goods are dispatched within 2–3 business days.


7. Risk

 Risk passes to the buyer once the goods have been delivered in accordance with section 6.


8. Returns and Right of Withdrawal

The right of withdrawal applies only to online purchases under the Right of Withdrawal Act. For hygiene and health reasons, no right of withdrawal applies to cosmetics that have been opened, used, or where the seal has been broken. Opened packaging is considered a used product. Testing scent, consistency, or application counts as use.


Unopened products may be returned within 14 days of receipt in original, unsealed condition. The buyer covers return shipping costs.


Returns due to dissatisfaction

We do not offer refunds or returns based on subjective dissatisfaction, including but not limited to: scent, consistency, feel on the skin, or personal preference. All product information including ingredients and scent description is clearly stated before purchase.


Claims 

Claims are only valid for actual defects or faults in the product under the Consumer Purchases Act, including production faults, incorrect packaging, or deviations from the stated ingredient list. Disliked scent or unmet expectations do not constitute a defect. Claims must be reported within a reasonable time with documentation if requested.


The buyer must notify the seller in writing at support@talgacosmetics.no within 14 days of wishing to exercise the right of withdrawal. The withdrawal period begins the day after the goods are received. The seller must refund the purchase price without undue delay and no later than 14 days after receiving notice.


9. Delay and Non-Delivery — Buyer's Rights

 If the seller fails to deliver on time and this is not caused by the buyer, the buyer may withhold payment, demand fulfilment, cancel the agreement, and/or claim compensation. All claims should be made in writing.


10. Defective Goods — Buyer's Rights and Complaint Deadline

 The buyer must notify the seller in writing within a reasonable time of discovering a defect. Notification within 2 months of discovery is always considered timely. The complaint deadline is a maximum of 2 years after receipt, or 5 years if the product is intended to last significantly longer. The buyer may withhold payment, request repair or replacement, demand a price reduction, cancel the agreement, and/or claim compensation. All complaints must be submitted in writing to support@talgacosmetics.no.


11. Seller's Rights in Case of Buyer's Breach 

If the buyer fails to pay or fulfil their obligations, the seller may withhold goods, demand fulfilment, cancel the agreement, and/or claim compensation, including interest on late payment and collection fees.


12. Warranty

 Any warranty given by the seller or manufacturer is in addition to the buyer's existing statutory rights and does not limit the right to make claims under sections 9 and 10.


13. Personal Data 

The seller is the data controller for collected personal data. Personal data is only collected and stored as necessary to fulfil the agreement, in accordance with the Personal Data Act. Data is only shared with third parties where necessary for fulfilment or required by law.


14. Dispute Resolution 

Complaints should be directed to the seller within a reasonable time per sections 9 and 10. The parties shall attempt to resolve disputes amicably. If this is not possible, the buyer may contact the Consumer Council for mediation at +47 23 400 500 or www.forbrukerradet.no.
